Basis Of Sale
1.1 All contracts between Igneous and the Customer accepting a quotation, and purchasing goods shall be on these terms and conditions of sale, to the exclusion of all other terms and conditions.
Orders and specifications
2.1 On receipt of an order from the Customer, Igneous will issue a formal written order acknowledgement, which will confirm the relevant specification details and price. It is the responsibility of the Customer to ensure that this acknowledgement correctly reflects its acceptance.
2.2 The quality, quantity and specification of goods shall be those set out in the order acknowledgement subject to the following.
2.3 All natural materials supplied are subject to their natural markings, veinings, variations in colour, cracks and vents. These are supplied reinforced where necessary and no claim on this account can be made.
2.4 When samples have been submitted, exact resemblances of the product supplied to the sample cannot be guaranteed. Where a uniform look is required we will endeavor to match materials as closely as possible; the Customers acceptance of reasonable variations is essential.
2.5 Any descriptions of material offered are guidance only and do not imply suitability for any particular purpose.
2.6 All thicknesses quoted are nominal and no liability is accepted for reasonable variations whatsoever nature.
Price of goods
3.1 The price for the goods is the price stated in the order acknowledgement. Unless otherwise stated all prices are given exclusive of VAT which will be chargeable at the rate applicable at the time of delivery.
3.2 In addition to the above, a standard charge of £75 will be made if any Igneous staff/contractors cannot carry out the agreed work on a pre-arranged date.
Terms of payment
4.1 Customers without an account with Igneous will be required to make payment as follows.
4.2 25% deposit upon completion of templating and the balance on delivery of the goods.
4.3 Customers with an account with Igneous will be required to make payment within thirty days of the date of invoice which will be submitted to the Customer on or after delivery of the goods.
4.4 No payment shall be deemed to have been received until Igneous has received cleared funds.
Templating, Installation and Delivery
5.1 It is the responsibility of the Customer to ensure that all existing worktops, sinks and hobs have been removed before templating commences. All base units must be fixed in their final position and must be perfectly level.
5.2 New appliances – sinks, hobs, taps etc must be available for Igneous to check.
5.3 Ensure that any items succeptable to damage are removed, where possible, before fitting commences. When handling granite our fitters are very careful, however granite is extremely heavy and can be difficult to handle in confined spaces. Igneous shall not be liable for such items that are left in place.
5.4 Please ensure that suitable spacing and supports are provided to accommodate undermounted sinks. An additional charge may be incurred if Igneous is required to carry out additional work when fitting.
5.5 It is the responsibility of the customer to prepare walls that are not straight or square. Igneous may need to slightly modify walls next to the granite worktop and although care is taken to minimise the damage of this procedure we shall not be liable for live plaster falls.
5.6 It is the responsibility of the Customer to ensure that all access to their property is clear and the ground even to prevent injuries and breakage when the goods are delivered.
5.7 Unfortunately breakages can and do occur during the manufacturing process – should this occur delays are unavoidable. Any dates quoted for delivery of the goods are approximate only and Igneous shall not be liable for any delay in delivery of the goods howsoever caused.
Cancellation of order
6.1 In the event of Igneous being unable to deliver or install the goods due to unavailability of the requested goods, or any other unforeseen circumstances, Igneous reserves the right to cancel the order and shall refund the deposit in full.
6.2 No order which has been accepted by Igneous may be cancelled by the Customer except with the agreement in writing from Igneous and on terms that the Customer shall indemnify Igneous in full against all loss and expenses incurred by Igneous as a result of cancellation.
Risk and property
7.1 Risk of damage to or loss of the goods shall pass to the Customer upon completion of installation or at the time of delivery, dependent on the order requirement.
7.2 Igneous shall not accept responsibility for damage to units that has been caused by the weight of the worktops fitted.
7.3 The property in the goods shall remain with Igneous until payment in full has been received.
Warranties and Liability
8.1 Subject to condition 2.2 and the conditions set out below Igneous warrants that goods will correspond with their description at the time of delivery.
8.2 Igneous shall be under no liability in respect of any defect in the goods arising from any drawing, design, specification or template supplied by or on behalf of the Customer.
8.3 Igneous shall be under no liability in respect of any defect arising from natural wear and tear, willful damage, negligence, abnormal working conditions, failure to follow Igneous instructions (whether oral or in writing), misuse or alteration or repair of the goods.
8.4 Any claim by the Customer which is based on any defect in the quality or condition of the goods or failure of the goods to correspond with their description shall be notified to Igneous within three days of delivery. If the Customer does not allow Igneous reasonable opportunity, after receiving notice, of examining the goods, the Customer shall not be entitled to reject the goods and Igneous shall have no liability for such defect or failure, and the Customer shall be bound to pay the price as if the goods had been delivered in accordance with the order acknowledgement.
8.5 Where any valid claim in respect of the goods which is based on any defect in the quality or condition of the goods or their failure to match their description is notified to Igneous in accordance with these conditions, Igneous shall be entitled to replace the goods (or the part in question) free of charge or, at the discretion of Igneous, refund the Customer the price of the goods (or a proportionate part of the price) but Igneous shall have no further liability to the Customer.
